商總理事長賴正鎰昨（29）日以觀光產業為例，一般進入台灣的觀光旅行團，多為八天七夜的行程，如依勞動部廢止「每周一天例假可挪移」相關函釋，帶團相關工作人員，如駕駛、導遊、領隊等，將在第七天停止工作，造成旅客權益受損。

賴正鎰還表示，目前政府提出的勞基法修正草案2.0版本，對服務業衝擊相當大，如果政府強行通過該版本，不遵守當初產、勞、資三方的共識，將號召商總旗下公會上街抗議。

商總昨日召開記者會，賴正鎰說，過去勞、資與官三方協商取得共識，也就是取消七天國定假日、彈性工時增加至54小時以及加班費用增加二倍，但近日來產生很大變化。

賴正鎰說，目前勞動部提出的加班費用計算方式，「加班一小時要付四小時費用」，相當不合理。

賴正鎰說，由於服務業各行各業屬性不同，難以量化所有服務業的加班費用，不過可以簡單來說，一旦勞基法2.0版本通過，等於雇主請100名員工，要付200名員工的人事成本。

商總指出，現行的勞基法其架構是以工廠勞工環境所設計出的法律，呼籲政府應該儘速訂定服務業勞動專章，讓所有服務業有合適法律可以依循。
